Terms of Service

To use the Moar Nation Platform, you must meet the following requirements:

• —You must be at least 13 years of age. Users between the ages of 13 and 17 may only use the Platform with verifiable parental or legal guardian consent.
• —Parents or guardians who consent on behalf of a minor accept full responsibility for that minor's use of the Platform, including all financial transactions made through the minor's account.
• —You must have the legal capacity to enter into a binding contract in your jurisdiction.
• —You must not be prohibited from using the Platform under applicable laws.

By creating an account, you represent and warrant that you meet all eligibility requirements listed above. Moar Nation reserves the right to request proof of age or parental consent at any time and to suspend or terminate accounts that do not comply.

To access certain features of the Platform, you must create an account. When registering, you agree to:

• —Provide accurate, current, and complete information.
• —Maintain and promptly update your account information.
• —Keep your login credentials confidential and not share your password with any third party.
• —Notify Moar Nation immediately at support@moarnation.com if you suspect unauthorized use of your account.

You are solely responsible for all activity that occurs under your account. Moar Nation will not be liable for any loss or damage arising from your failure to maintain the security of your account.

All payments on the Moar Nation Platform are processed by Stripe. By using the Platform, you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms. Moar Nation does not store your full payment card details.

You agree to pay all charges incurred through your account, including applicable taxes. Moar Nation reserves the right to correct any pricing errors and to update fees with reasonable advance notice. Continued use of the Platform after a fee change constitutes acceptance of the new pricing.

The following content and conduct are strictly prohibited on Moar Nation:

• —Adult, sexually explicit, or pornographic content of any kind.
• —Content that exploits, depicts, or endangers minors in any way.
• —Hate speech, harassment, threats, or content that promotes violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
• —Content that infringes upon the intellectual property rights of any third party.
• —Fraudulent, deceptive, or misleading content, listings, or representations.
• —Spam, phishing, or any form of unsolicited communication.
• —Content that violates any applicable local, national, or international law or regulation.
• —Content promoting illegal activities, including drug use, weapons trafficking, or money laundering.

Moar Nation reserves the right, in its sole discretion, to remove any content that violates these prohibitions or that it otherwise deems harmful to the Platform or its community.

Moar Nation evaluates refund requests on a case-by-case basis. There is no automatic entitlement to a refund for merchandise purchases, one-time donations, or monthly membership fees. Refund decisions will take into consideration factors such as:

• —Whether the merchandise was significantly not as described or was damaged upon arrival.
• —Whether a technical error on the Platform resulted in an unintended charge.
• —The nature of the transaction and the circumstances presented by the requesting party.

To submit a refund request, fans must contact Moar Nation support at support@moarnation.com within a reasonable time of the transaction. Moar Nation's decision on refund requests is final. Approved refunds will be processed through the original payment method and are subject to Stripe's processing timelines.

Moar Nation reserves the right to immediately terminate or suspend any account, at its sole discretion and without prior notice, for violation of these Terms, including but not limited to:

• —Posting prohibited content as described in Section 7.
• —Engaging in fraudulent or deceptive conduct.
• —Any activity that Moar Nation reasonably determines to be harmful to the Platform, its users, or third parties.

Upon termination, your right to access the Platform ceases immediately. Any pending payouts to creators at the time of termination for cause may be forfeited. Fans with active monthly memberships will receive a pro-rated refund at Moar Nation's discretion. Moar Nation's decision to terminate an account is final.

Your privacy is important to us. Moar Nation's Privacy Policy, which is incorporated into these Terms by reference, describes how we collect, use, and share information about you when you use the Platform. By using Moar Nation, you consent to the collection and use of your data as described in the Privacy Policy.

The Platform operates worldwide. By using the Platform, you consent to the transfer of your data to and processing in the United States and any other country where Moar Nation or its service providers operate. Where required by law, such as under the General Data Protection Regulation (GDPR) or the California Consumer Privacy Act (CCPA), Moar Nation will comply with applicable data protection requirements.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Moar Nation does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Moar Nation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use the Platform.

Moar Nation's total aggregate liability for any claims arising under these Terms shall not exceed the greater of (a) one hundred dollars ($100) or (b) the amount you paid to Moar Nation in the three (3) months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in California. For purposes of these Terms, the contracting entity is ZikVid, Inc., a company incorporated in the State of California.

Before initiating any legal action, both parties agree to make a good-faith effort to resolve disputes informally by contacting Moar Nation at support@moarnation.com. If informal resolution is not achieved within thirty (30) days, either party may pursue available legal remedies.

Moar Nation reserves the right to modify these Terms at any time. When we make material changes, we will notify users via email or a prominent notice on the Platform prior to the change becoming effective. The date of the most recent revision will be reflected in the "Effective Date" at the top of this document.

Your continued use of the Platform after the effective date of any revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must discontinue use of the Platform.

Entire Agreement. These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and ZikVid, Inc. with respect to the Platform.

Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

No Waiver. Moar Nation's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign your rights or obligations under these Terms without ZikVid, Inc.'s prior written consent. ZikVid, Inc. may assign its rights and obligations freely.
